CITY OF NEZPERCE, IDAHO

SPECIAL MEETING

July 25, 2022

MINUTES OF THE PUBLIC HEARING OF THE NEZPERCE CITY COUNCIL OF THE CITY OF NEZPERCE, IDAHO, HELD ON July 25, 2022.

PLACE:  Training Room, Nezperce City Hall, 606 Maple Street.

THE MEETING WAS CALLED TO ORDER BY MAYOR BATEMAN AT 7:00P.M.

PRESENT were Councilmembers Steve Bateman, Mike Jensen and Tyler Nelson; Kimberly J. Ingram and James Zenner were (via Zoom), Maintenance Supervisor Craig Cardwell, Office Assistant Kim Johnson Ingram and Clerk/Treasurer Rhonda Schmidt.

Guests present were: Darlene Thompson, Terry Perrine, Kyle Stapleton, and Shawn Tiegs all local residents; CEDA grant writer Angie Edwards Kuskie and JUB engineer Amy Uptmor.

Pledge of Allegiance:  The pledge was led by Mayor Bateman.

PUBLIC COMMENT

No members of the public in attendance wanted to make comment prior to the public hearing business.

BUSINESS TO BE CONDUCTED

1.  Public Hearing on Proposed Zoning Ordinance: Mayor Bateman opened the public hearing on the Nezperce City Zoning Ordinance No. 2022-3 and asked for public comments and or testimony. Mayor Bateman declared that a summary of the proposed ordinance was published with the public hearing notice and that a copy of the full proposed ordinance with exhibits was provided to the city council members for review and consideration and was available for public inspection.

No testimony was given or questions asked of the council.

Mayor Bateman asked for a motion to close the public hearing on Nezperce City Ordinance No. 2022-3. Cm. Nelson moved to close the public hearing on Ordinance No. 2022-3, motion was seconded by Cm. Jensen. Mayor Bateman asked for a roll call vote.

Roll call vote was as follows:

            Cm. Nelson, aye;

            Cm. Jensen, aye;

            Cm. Zenner, aye;

            Cm. Ingram, aye.

2.  Public Hearing on Proposed Annexation Ordinance: Mayor Bateman opened the public hearing on the Nezperce City Annexation Ordinance No. 2022-5 and asked for public comments and or testimony. Mayor Bateman declared that a summary of the proposed ordinance was published with the public hearing notice and that a copy of the full proposed ordinance with exhibits was provided to the city council members for review and consideration and was available for public inspection.

Darlene Thompson asked if the Gun Club is annexed into the city limits will they there be a  problem with the use or will there be a change of use at the Gun Club? Mayor Bateman answered that the use at the club will not change.

Kyle Stapleton wanted to verify that the school annexation will be zoned to allow for animals as the school is building an FFA facility to raise animals for the fair. Mayor Bateman verified that the school annexation will be Zone D- Industrial which allows for animals. Kyle also asked if he will be required to get a new building permit as the school has already received a permit through the county. Mayor Bateman advised that the city will accept the county’s permit and will not require the school to get a city permit.

Mayor Bateman asked for additional comments and when none were received. Mayor Bateman asked for a motion to close the public hearing on Nezperce City Ordinance No. 2022-5. Cm. Nelson moved to close the public hearing on Ordinance No. 2022-5, motion was seconded by Cm. Jensen. Mayor Bateman asked for a roll call vote.

Roll call vote was as follows:

            Cm. Nelson, aye;

            Cm. Jensen, aye;

            Cm. Zenner, aye;

            Cm. Ingram, aye.

3.  Adoption of Zoning Ordinance:  Mayor Bateman declared that the next item on the agenda is consideration of adoption of the Nezperce City Ordinance No. 2022-3 Mayor Bateman added for the record that a summary of the proposed ordinance was published with the public hearing notice and that a copy of the full proposed ordinance with exhibits was provided to the city council members for review and consideration and was available for public inspection.

Mayor Bateman then read out loud the Title Section of the proposed Nezperce City Ordinance No. 2022-3 and asked for a motion to dispense with the rule requiring 3 different readings by title or in full, to dispense with the second and third readings of the ordinance, and proceed with consideration of adoption of the Nezperce Ordinance No. 2022-3 as presented. Cm. Nelson moved to suspend the 3-reading rule and move to adoption of the ordinance. Cm. Jensen seconded the motion. Mayor Bateman asked for a roll call vote.

Roll call vote was as follows:

            Cm. Nelson, aye;

            Cm. Jensen, aye;

            Cm. Zenner, aye;

            Cm. Ingram, aye.

Mayor Bateman asked for a motion to adopt Nezperce City Ordinance No. 2022-3 as presented. Cm. Zenner moved to adopt the Zoning Ordinance as presented, Cm. Jensen seconded the motion. Mayor Bateman asked for a roll call vote.

5.  Adoption of Resolution Approving Publication of Zoning and Annexation Ordinance Summaries: Mayor Bateman declared that a certified copy of the Zoning Ordinance was prepared by the attorney for the city, and has been provided to the city council for review and approval for publication. Mayor Bateman then asked for a motion to approve for publication of the certified summary of the Zoning Ordinance in lieu of publishing the entire text of the ordinance. Cm. Nelson moved to publish the summary as prepared, motion was seconded by Cm. Jensen. Mayor Bateman then asked for a roll call vote.

            Cm. Nelson, aye;

            Cm. Jensen, aye;

            Cm. Zenner, aye;

            Cm. Ingram, aye.

6.  Adoption of Bond Ordinance: Mayor Bateman declared that the next item on the agenda is consideration of adoption of the Nezperce City Bond Ordinance No. 2022-7. Mayor Bateman added that a copy of the full proposed ordinance was provided to the city council members for review and consideration.

Mayor Bateman then read out loud the Title Section of the proposed Nezperce City Ordinance No. 2022-7 and asked for a motion to dispense with the rule requiring 3 different readings by title or in full, to dispense with the second and third readings of the ordinance, and proceed with consideration of adoption of the Nezperce Ordinance No. 2022-7 as presented. Cm. Nelson moved to suspend the 3-reading rule and move to adoption of the ordinance. Cm. Jensen seconded the motion. Mayor Bateman asked for a roll call vote.

Roll call vote was as follows:

            Cm. Nelson, aye;

            Cm. Jensen, aye;

            Cm. Zenner, aye;

            Cm. Ingram, aye.

Mayor Bateman asked for comments if any regarding the Bond Ordinance. No one had any questions then Mayor Bateman for a motion to adopt Nezperce City Ordinance No. 2022-7 as presented. Cm. Nelson moved to adopt the Bond Ordinance as presented, Cm. Zenner seconded the motion. Mayor Bateman asked for a roll call vote.

Roll call vote was as follows:

            Cm. Nelson, aye;

            Cm. Jensen, aye;

            Cm. Zenner, aye;

            Cm. Ingram, aye.

Mayor Bateman then asked for a motion to approve publication of the certified summary prepared by an attorney for the city in lieu of publishing the entire text of the ordinance. The council was given a copy of the summary for review. Cm. Zenner moved to publish the certified summary as prepared, Cm. Jensen seconded the motion. Mayor Bateman asked for a roll call vote.

Roll call vote was as follows:

            Cm. Nelson, aye;

            Cm. Jensen, aye;

            Cm. Zenner, aye;

            Cm. Ingram, aye.

7.  Adoption of BAN Resolution:  Mayor Bateman then read the BAN Resolution Title and explained that this resolution authorizes the use of the Bond. Mayor Bateman declared that the council has received the resolution in its entirety to review previous to the meeting and asked for a motion to sign the BAN Resolution No. R2022-6. Cm. Zenner moved to adopt the resolution as presented, Cm. Jensen seconded the motion. Mayor Bateman asked for a roll call vote.

            Cm. Ingram, aye.

8.  Adoption of Resolution Re: Purchase of Payne Property: Mayor Bateman read Nezperce City Resolution No. R2022-8 in its entirety. This resolution gives the city the authorization to purchase certain real property from Ronald Payne. Following the reading Mayor Bateman asked for a motion to adopt the resolution to purchase said property. Cm. Nelson moved to adopt the resolution as read, Cm. Zenner seconded the motion. Mayor Bateman asked for a roll call vote.

COUNCIL COMMENT

Mayor Bateman offered that the city has a few opportunities for growth in the future. The city is currently negotiating on some property on the east side of town which will allow the city to widen and finish Ash Street and give us the area we need for the city Wellhead Protection Plan which is part of the Zoning Ordinance. Our goal is to give us more distance between the well on the east side of town from neighboring farm ground. Water testing has shown nitrates from that well and pushing the crop back will help with the nitrate issue.

ADJOURNMENT: Mayor Bateman adjourned the meeting 8:12PM.
