REGULAR MEETING
September 8, 2025
MINUTES OF THE REGULAR MEETING OF THE NEZPERCE CITY COUNCIL OF THE CITY OF NEZPERCE, IDAHO, HELD ON September 8, 2025
PLACE: Nezperce City Hall, 606 Maple Street. Time: 7:00AM
THE MEETING WAS CALLED TO ORDER BY Mayor Tyler Nelson at 6:56AM
PLEDGE OF ALLEGIANCE
PRESENT were Councilmembers Tyler Nelson, Jim Zenner, Kelby Heartburg, Mike Jensen and Kim Ingram; Fire Chief Dave Kuther, Maintenance Supervisor Craig Cardwell, Clerk/Treasurer Rhonda Schmidt. Resident in attendance was Mitchell Barnett.
PUBLIC COMMENT: Mitchell Barnett presented a request for a conditional use permit. He would like to place a manufactured home on two of the three family-owned lots. The conditional use permit is required to place a manufactured home on a lot that already has a home on it. Mayor Nelson called for a motion to approve a conditional use permit. Motion was made by Cm. Jensen and was seconded by Cm. Heartburg, motion carried.
MINUTES of the previous meetings of 08/11/2025 and 8/21/2025 were approved by a motion by Cm. Heartburg, motion was seconded by Cm. Zenner, motion carried.
TREASURER REPORT AND MONTHLY BILLS:
The Clerk’s Monthly Treasurer’s Report dated September 8, 2025, was examined and approved, showing the following:
Funds on Hand $ -124,498.45 (includes a grant disbursement for $631,216.60 and pool approximate figures as not received)
All bills and payroll disbursements were examined and approved for payment upon motion by Cm. Jensen and seconded by Cm. Heartburg, motion carried. Disbursements totaled $707,600.40, which included a grant disbursement of $631,216.60, check numbers 18059, 18270 through 18307. Receipts from the last meeting were shown to be $924,667.49. Checks and stub approvals were signed appropriately by all parties as well, and all signed the Claim Approval Report for September.
BUSINESS TO BE CONDUCTED
- DAR Proclamation for Constitution Week: The Alice Whitman chapter of the Daughters of the American Revolution asked that the council declare September 17-23 Constitution Week in Nezperce. Cm. Jensen moved to accept and sign the proclamation. Cm. Heartburg seconded the motion, motion carried.
- Resolution R2025-10 – Impact Area: The council reviewed the resolution that revises the original city impact area for adoption and for submission to the Lewis County Commission. Mayor Nelson asked for a motion to accept the resolution as drafted. Cm. Zenner moved to accept the resolution, motion was seconded by Cm. Heartburg, motion carried.
- Solid Waste Contract: Council reviewed the contract for Walco. Mayor Nelson called for a motion. Cm Jensen made a motion to approve the contract, Cm Heartburg seconded, and the motion carried.
- Land App Project Update: Maintenance Cardwell informed the council that the runway protection zone is nearly complete, so the airport is open again, and they are getting lines in the ground and under the creek. Pouring of the floor for the building will be next week, trusses are coming from CDA. Cardwell scheduled a meeting with ACS to discuss options for the alarm system Thursday. Maintenance is installing the conduit to connect the lift station to the new control building. Maintenance is also getting things exposed so that the temporary electrical can go in and so the old building can come down.
- Change Order Phase 1 #5 and Phase 2 #3: Neither CO has been received so they were tabled to a special meeting.
- Fiber Project Update: Maintenance cleaned up an area on the east side of the airport for staging. They need electricity and we have conduit in the ground there that will need to be connected for the contractor to use. The current plan is to start in the City of Nezperce and work towards Orofino. Work is scheduled to begin on September 9, 2025.
- Mutual Aid Agreement: This agreement is between the Nezperce Russell Cemetery District and the City of Nezperce as both entities share the same clerk. The NRCMD thought that it would be beneficial to both entities to have an agreement. Cm. Zenner moved to approve and sign the agreement, Cm. Jensen seconded the motion, motion carried.
- Nuisance Property Update: The council reviewed a letter addressed to the residents at 105 2nd regarding ordinance issues. The council approved the letter so the letter will be mailed this week.
- Request to close Pine Street for Tough Truck Competition Sunday of the Fair: Council has no issue and was fine with a closure if they need it.
- November 4th Election Update: The clerk’s office received four declarations of candidacy so there will be an election. Those filing for candidacy were Mike Jensen for a 2-year term for council, Kim Ingram for a 4-year term for council, Kelby Heartburg for a 4-year term for council, and Chase Lunders for a 4-year term for council.
DEPARTMENTAL REPORTS
- Maintenance
Water: Wells are recovering from the hot summer to help the situation the school as slowed down on watering. Lead and Copper samples will be completed this month.
Streets: Maintenance will be replacing old manhole covers in streets.
Parks: The stumps have been removed, and the debris cleaned up.
EMS Building: The lights on the city hall are blinking maintenance will call City Electric to fix.
- Clerk:
Clerks Conference: Rhonda and Leigh will be gone Sept. 22-25 for conference, Bridget will be working each day for 4 hours to handle the office.
- Fire Department:
Chief Kuther reported that we were lucky this summer as it was a very dry season. Plans are under way to exercise a few hydrants prior to the fair. Chief Kuther recently purchased some gear and split it with Rural Fire so they are good on the following equipment: helmets, goggles and gloves.
- Code Enforcement: nothing to report.
COUNCIL COMMENT/OTHER: Cm. Zenner asked that we put a reminder in the Herald that owners need to clean up after dogs when walking in town. Cm. Ingram reported that in memory of Ron Grant they are asking for donations to the pickleball court in lieu of flowers. They have collected around $3,000.
ADJOURNMENT: Cm. Zenner moved to adjourn the meeting at 8:52AM, motion was duly seconded by Cm. Heartburg, motion carried.

The next regularly scheduled city council meeting will be on Tuesday, October 14th at 5:30PM at City Hall.
