ORDINANCE NO. 2018-7
ANNUAL APPROPRIATION ORDINANCE

AN ORDINANCE OF THE CITY OF NEZPERCE, IDAHO, ENTITILED THE ANNUAL APPROPRIATION ORDINANCE FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2018, AND ENDING ON SEPTEMBER 30, 2019, APPROPRIATING THE SUM OF $818,273.00 TO DEFRAY THE EXPENSE AND LIABILITIES OF THE CITY OF NEZPERCE FOR SAID FISCAL YEAR, AUTHORIZING A LEVY OF SUFFICIENT TAX UPON THE TAXABLE PROPERTY AND SPECIFIYING A LEVY OF A SUFFICIENT TAX UPON THE TAXABLE PROPERTY AND SPECIFYING THE OBJECTS AND PURPOSES FOR WHICH SAID APPROPRIATION IS MADE:

BE IT ORDAINED by the Mayor and Council of the City of Nezperce, Lewis County, Idaho:

Section 1: That the sum of $818,273.00 be, and the same is appropriated to defray the necessary expenses and liabilities of the City of Nezperce, Lewis County, Idaho for the fiscal year beginning October 1, 2018.

Section 2: The objects and purpose for such appropriation is made, and the amount each object and purpose is as follows:

Section 3: That a general tax levy on all taxable property within the City of Nezperce be levied in an amount allowed by law for the general purposes for said City, for the fiscal year beginning October 1, 2018.

Section 4: All ordinances and parts of ordinances in conflict with this ordinance are hereby repealed.

Section 5: This ordinance shall take effect and be in full force upon its passage, approval and publication in one issue of the Lewis County Herald, a newspaper of general circulation in the City of Nezperce, and the official newspaper of said City.

PASSED under suspension of rules upon which a roll call vote was taken and duly enacted an Ordinance of the City of Nezperce, Lewis County, Idaho at a convened meeting of the City of Nezperce City Council held on the 28th day of August 2018.

A RESOLUTION ESTABLISHING CITY
FEE INCREASES; AND PROVIDING AN EFFECTIVE
DATE.

NOW THEREFORE; BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF NEZPERCE, IDAHO, TO WIT:

In accordance with Chapter 4 of the revised and compiled code or ordinance of the City of Nezperce, Section 3-4, RATES, the following rates are hereby established with a 3% increase effective October 1, 2018:

THEREFORE BE IT RESOLVED, This resolution shall take effect and be in full force from and after its passage and approval.

Ordinance No. 2018-3

AN Ordinance of the City of Nezperce, Idaho amending certain portions of the Revised and Compiled Code of Ordinances for the City of Nezperce, providing for repeal of inconsistent ordinances; providing the ordinance to become effective upon passage and publication.

Be it ordained by the Mayor and City Council of the City of Nezperce, Lewis County, State of Idaho, as follows, to wit:</p

Section 1: Title I, Chapter 12, Section 1-1204 of the revised and compiled code or ordinances for the City of Nezperce, shall be revised to read as follows:

Title I – Administrative

Chapter 2 CITY COUNCIL

Section 1-1204 Time and Place of Meeting: The Council shall hold regular meetings on the 2nd Tuesday of each month and shall commence at 5:30 p.m. in the months October through March and shall commence at 6:30 p.m. in the months April through September. (Balance of section to remain unchanged)

Section 2: All ordinances or portions thereof inconsistent with the provision of this ordinance are hereby repealed.

Section 3: Effective Date

This ordinance shall be effective upon its passage, approval and publication in the Lewis County Herald, the official publication of the City.

Passed Under Suspension of all rules and regulations of this City Council upon which proper roll call votes were duly taken and duly enacted, an Ordinance of the City at a regular meeting of the Mayor and City Council of the City of Nezperce, Idaho, held on the 8th day of May, 2018.

Policy Regarding Nondiscrimination
on the Basis of Disability
Resolution No. R-2018-1

A resolution of the City of Nezperce, Idaho adopting a policy of nondiscrimination on the basis of disability.

Whereas, the Congress of the United States has passed and Section 504 of the Rehabilitation Act of 1973, which requires that “no otherwise qualified individual with a disability shall, solely on the basis of his or her disability, be excluded from participation in, be denied the benefits of, or be subject to discrimination under any program, services or activities receiving federal assistance”; and

Whereas the failure to comply with the terms and conditions of Section 504 of the Rehabilitation Act may cause the City/Counsel to lose its grant or eligibility for future grants;

Now, therefore, be it resolved by the Mayor and the Council of the City of Nezperce, Idaho, the following:

Section I: It is the policy of the City that all programs, services and activities shall be accessible to and usable by, individuals with disabilities, in accordance with Section 504 and the Americans with disabilities Act (ADA).

Section II: That the city shall conduct a self-evaluation, which should include the assistance of a citizen review committee involving individuals with disabilities, or its programs, policies, procedures and facilities to determine those areas where discrimination may occur.

Section III: The City shall, upon completion of the self-evaluation plan, make revisions, modifications, or other changes so as to fully comply with the letter and intent of Section 504 and the ADA.

Section IV: Further, the City shall, where building modifications are required, develop and implement a transition plan for eliminating architectural barriers in a timely manner in accordance with Section 504 and the ADA.

Appropriation Ordinance Amendment

An ordinance of the City of Nezperce, Idaho amending Ordinance 2016-8, The Appropriation Ordinance for the Fiscal Year beginning October 1, 2016, appropriating monies that are to be received by the City of Nezperce, Idaho in the sum of $250,000; providing for repeal of confliction provisions and providing an effective date.

BE IT ORDAINED by the Mayor and Council of the City of Nezperce, Lewis County, Idaho:

Section 1: That Ordinance No. 2016-8, the appropriations ordinance for the city of Nezperce, Idaho for the fiscal year commencing October 1, 2016, be, and the same is hereby amended as follows:

That then additional amount of $250,000 be appropriated of the revenues of the General Fund to be used for construction of the Emergency Facilites Building.

Section 2: All ordinances and parts of ordinances in conflict with this ordinance are hereby repealed.

Section 3: This ordinance shall take effect and be in full force upon its passage, approval and publication in one issue of the Lew County Herald, a newspaper of general circulation in Lewis County and the official newspaper of said City.
