CITY OF NEZPERCE
ORDINANCE NO. 2021-5

AN ORDINANCE OF THE CITY OF NEZPERCE, IDAHO AMENDING CERTAIN PORTIONS OF THE REVISED AND COMPILED ORDINANCES FOR THE CITY OF NEZPERCE (AS ADOPTED BY ORDINANCE 1997-1); ESTABLISHING THE PENALTY FOR ALL VIOLATIONS OF THE DOG ORDINANCE TO BE AN INFRACTION PUNISHABLE BY A FINE NOT TO EXCEED $300; AND PROVIDING THAT THE ORDINANCE BECOME EFFECTIVE UPON ITS’ PASSAGE, APPROVAL, AND PUBLICATION ACCORDING TO LAW.

Be it ordained by the Mayor and City Council of the City of Nezperce, Lewis County, State of Idaho, as follows, to wit:

Section 1: Title VI, Chapter 3, Section 6-314 of the Revised and Compiled Code of Ordinances set forth in Ordinance 1997-1 of the City of Nezperce, shall be revised to read as follows:
6-314: PENALTY FOR VIOLATION
Any person violating any portion of Ordinance 1997-1 shall be guilty of an infraction, with the penalty being a fine not to exceed $300 plus court costs.
A.  Upon conviction for fourth offense involving the same animal and/or the same owner, the dog, after hearing before the city council, the offending animal may shall be destroyed in a humane manner by the Animal Control Officer.
Section 2: All ordinances or portions thereof in conflict with this ordinance are hereby repealed to the extent of such conflict.
Section 3: This ordinance shall be effective upon its passage, approval and publication in the Lewis County Herald, the official publication of the City.

Enacted by the City Council as an ordinance of the City of Nezperce on the 14th day of June, 2021.
Approved by the Mayor on the 14th day of June, 2021.
